in Washington State (extended abstract) SESSION 11: Indian Water Resources Law and Policy The Water Policy and Indian Law Special Session consists of five presentations on the policy and legal aspects of tribal water resource issues. Ms. Rebecca Miles, Chair of the Nez Perce Tribe's Executive Committee will speak, as well as other representatives of Northwest tribes and law firms which have handled many Indian cases related to fishing and water rights, sovereign immunity, tribal resources, and regulatory authority. The topics to be addressed include balancing fish and economic development, managing on- and off-reservation water resources, negotiating Indian water settlements, tribal water quality concerns, and ESA and water management. Participants: Tim Weaver, Esq.: Mr. Weaver is a member of the Washington State Bar and has represented the Yakama Nation for more than 30 years in both the U.S. v. Oregon and U.S. v. Washington fishing rights cases. Rebecca Miles: Ms. Miles is the chair of the Nez Perce Tribe's Executive Committee. Ms. Miles was actively involved in negotiation of a far-reaching settlement of the Nez Perce Tribes water rights claims in the Snake River Basin Adjudication. Mason Morisset, Esq.: Mr. Morisset is a partner in the law firm of Morisset, Schlosser, Jozwiak and McGaw. The firm has handled many Indian cases related to fishing and water rights, gaming, sovereign immunity, tribal resources, and regulatory authority Naomi Stacey, Esq.: Ms. Stacey is an attorney for the Confederated Tribes of the Umatilla Indian Reservation and is handling the tribe's case now before the Washington State Supreme Court concerning the duties of the Washington Department of Ecology to consult with Indian tribes in issuing water withdrawal permits in the State of Washington. Harry Chesnin, Esq. (invited): Mr. Chesnin is a member of the Washington
State Bar and represents the Upper Skagit and the Chehalis tribes in a

abstract) SESSION 21: Hydrological Connectivity between Headwater Systems and Downstream Waters - I This special session explores the roles played by headwaters in maintaining the physical, chemical, and biological integrity of waters in lower watershed positions. There are several policy considerations that make this topic very timely, primary among them the 2001 U.S. Supreme Court ruling in SWANCC (Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers) that the U.S. Army Corps of Engineers exceeded its statutory authority by asserting Clean Water Act (CWA) jurisdiction over non-navigable, isolated, intrastate waters based solely on their use by migratory birds. The Court's majority opinion in SWANCC also touched upon broader issues of CWA jurisdiction; the Court's reasoning implies that the CWA intended some "connection" to navigability to be jurisdictional. Since SWANCC, extensive public debate and over 35 federal court decisions have addressed headwaters and intermittent and ephemeral streams. Topics to be explored during this special session include the relative roles of surface water and ground water flow paths, the spatial and temporal scales over which hydrological connectivity is relevant, and ecosystem function at landscape scales. The first ten minutes of this session will be devoted to introductory remarks, with the individual presentations following. It will continue in the session immediately following this one (Session 26) with a wrap-up at the end by Mark Rains. Practices (abstract) SESSION 46: Panel on Dam Removal and River Restoration: The Changing Waterscape of Science, Policy, and People Although a number of small dam removal projects have been conducted throughout the United States, increasing pressure for salmon recovery has produced a number of proposals for the removal or decommissioning of large dams in the western U.S. These proposals are often controversial, and raise new challenges both in terms of science, policy, and their impacts on people in the communities affected by the dams. This panel will explore the theory, research, and on-the-ground experiences of dam removal and river restoration projects in the Pacific Northwest and throughout North America. The panel includes four members who have done extensive work on this subject, and will provide their perspectives on the evolving landscape of dam removal as a river restoration tool.
