    A RESOLUTION implementing Emergency Resolution No. 99-1, to restrict nonessential water uses in communities located in the Delaware River Basin.

    WHEREAS, the Commission has authorized the declaration of a state of water supply emergency by its Resolution No. 99-1; and

    WHEREAS, reduction or elimination of nonessential water uses can help relieve the water supply emergency; now therefore,

    BE IT RESOLVED by the Delaware River Basin Commission:

    1. The signatory states shall restrict nonessential uses of fresh water in Delaware Basin communities in accordance with the state drought contingency plans. The restrictions shall apply to all areas within the Basin, exclusive of Cumberland and Cape May Counties in New Jersey and the area below the Chesapeake and Delaware Canal in Delaware.

    2. For the purposes of this resolution, the following are considered nonessential water uses:

      (a) The use of water for watering of lawn, garden, landscaped areas, trees, shrubs or other outdoor plants except commercially grown food crops and sod, and nursery stock at nurseries or retail outlets;

      (b) The use of water for washing paved surfaces such as streets, roads, sidewalks, driveways, garages, parking areas, tennis courts and patios;

      (c) The use of water for watering any portion of golf courses except for tees and greens;

      (d) The use of water for ornamental purposes including fountains, artificial water falls and reflecting pools;

      (e) The use of water for washing of non-emergency vehicles except by businesses engaged exclusively in car washing;

      (f) The use of water from a fire hydrant for any purposes (including the use of sprinkler caps) except for fire fighting, or health protection purposes;

      (g) The use of water for flushing sewers or hydrants except as deemed necessary in the interest of public health and safety;

      (h) The serving of water in restaurants, clubs or eating places unless specifically requested by a customer.

    3. During the water supply emergency the restrictions on nonessential uses shall be referenced as a condition in all water supply permits issued by the states and the Commission pursuant to Section 3.8 of the Delaware River Basin Compact.

    4. This resolution shall take effect as provided in Emergency Resolution No. 99-1.
