    A RESOLUTION implementing Emergency Resolution No. 99-1 and requiring drought contingency plans by major water users.

    WHEREAS, the Commission has authorized the declaration of a state of water supply emergency by its Emergency Resolution No. 99-1; and

    WHEREAS, the signatory party states have taken or will take curtailment actions, as necessary, regarding major users within individual public water supply systems; and

    WHEREAS, there exist major users within the Basin who are not on public water supplies; and

    WHEREAS, temporary curtailment in water use by large water users in the Basin can have a beneficial impact on stressed public water supplies, streamflows and protection against salinity intrusion in the estuary; now therefore,

    BE IT RESOLVED by the Delaware River Basin Commission:

    1. All self-supplied users of ground or surface waters in the Delaware River Basin, exclusive of those in Cumberland and Cape May Counties in New Jersey, and below the Chesapeake and Delaware Canal in Delaware, whose use for any purpose was in excess of an average of 1 mgd during any 30-day period from January 1, 1998 to December 31, 1998, shall prepare contingency plans for water curtailment in the event that is necessary and submit those plans to the Commission.

    2. The information requested by DRBC shall include:

      (a) source of water supply;

      (b) for the past two months:

        amount withdrawn (average mgd)

        amount consumed (difference between quantity withdrawn and quantity returned)

      ;

      (c) for the next six months estimate:

        amount to be withdrawn (average mgd)

        amount to be consumed (average mgd);

      (d) description of recycling and conservation measures;

      (e) point of discharge (where water is returned or discharged);

      (f) types of products produced;

      (g) normal employment levels (numbers); and

      (h) estimated employment (numbers) and economic impact ($) for curtailment of water usage for the following levels of curtailment: 10%; 25%; 35%; 50% and 100%.

    3. The Executive Director shall notify all major water users subject to the requirements of this conservation order and request submission of contingency plans within 20 days after the state of emergency shall go into effect.

    4. Implementation of contingency plans or orders for water use curtailment shall be at the discretion of the Commission.

    5. This resolution shall take effect as provided in Emergency Resolution No. 99-1.
